These General Conditions of Sale govern the contractual relationship between Julien Pierron and any person or entity wishing to purchase Products on the Site.

Subject

The aim of these General Conditions of Sale is to determine the contractual relations between the Vendor and the Buyer and to clarify the conditions applicable to all purchases made through the Site.

1. Applicability and validity of conditions of sale

All purchases imply the Buyer's full acceptance of these Conditions of Sale, without any reservation whatsoever and to the exclusion of any other document.
No special conditions will take precedence over these Conditions of Sale.

The purchase of any Product implies the Buyer accepts these Conditions of Sale and waives his own general terms and conditions. Any other disposition, in the absence of manifest consent, will be ineffective against the Buyer, regardless of the time at which he/she may have been made aware of it.

That the Vendor does not exercise one or more of the provisions in these Conditions of Sale shall not be interpreted as a waiver of the Vendor's right to exercise any of the provisions in these Conditions of Sale at a later date.

2. Order

All orders are payable only via PayPal payment system.

After selecting a Product offered for sale and clicking the "Pay" button, the Buyer is redirected to PayPal’s website to make payment.

3. Payment

The purchase of the Products is made only via PayPal payment system. It is possible to pay by credit card or with a PayPal account. The price is payable in full in one payment at the time the order is placed.

The Buyer confirms its purchase by clicking on the button "Pay", hereinafter referred to as "Acceptance". The Acceptance will conclusively evidence the Buyer's total and unconditional acceptance of these General Conditions of Sale. As of Acceptance, the purchase is confirmed and cannot be canceled or refunded, even if the Buyer decides to abandon the download of the Product. The Buyer may abandon his purchase until Acceptance.

4. Download and activation

The Buyer can download any Product at any time, however an activation code is required to activate the Product. After payment, the Buyer receives an e-mail (sent at the e-mail address the Buyer gave during the payment) containing information about how to activate the Product. Access to the purchased Product activation page is open to the Buyer only, solely as an individual.

During the payment process, it is advisable for the Buyer to properly verify the accuracy of the information he provides (name, e-mail address) to avoid any failure in delivery of the confirmation e-mail.

It has also advisable for the Buyer to check the Anti-Spam or Junk folder of his e-mail address which could contain the e-mail containing activating information.

5. Price

All the prices of Products include taxes.

Due to the status of “auto-entrepreneur” of the Vendor, the prices are calculated without VAT.

The Vendor reserves the right to change the prices at any time, without notice or justification, but undertakes to apply the prices in effect at the date the Buyer makes his purchase.

6. Right of retractation

The purchase of dematerialized Products is firm and final, no refund or exchange will be granted.

The Buyer acknowledges that the seven days period following the date of delivery to return the Products (in accordance with the provisions of the L.121-16, L.121-20 and following articles of the French Code of Consumption) is not applicable to dematerialized Products. The purchase of the Product is considered as acceptance of the Product.

If the Buyer does not receive the Product activation link on the e-mail address he had specified when placing the order, the Buyer may contact the Vendor to request the sending of the activation link.

7. Responsibility

Any obligation of the Vendor in the process of selling the Products on the Internet is an obligation of means. The Vendor cannot be held liable for damages suffered by the Buyer resulting from the use of the Internet such as intrusion, data loss, service disruption, computer virus infection or other problems beyond the reasonable control of the Vendor.

The Vendor cannot be held liable for any direct, indirect or consequential damages resulting from the use of the Site or inability to use it.

As the Buyer is responsible for the information he provides during the payment process through PayPal (especially the e-mail address on which the information of the Product will be sent), the Vendor accepts no responsibility or liability for incomplete or incorrect e-mail address and cannot be held responsible for the consequences of any error in this information.

The Vendor accepts no responsibility or liability in case of dispute between the Buyer and the PayPal Company.

The Vendor accepts no responsibility or liability for any breach of contract due to force majeure (French Civil Code).

The Vendor accepts no responsibility or liability for the contents of any third party site to which a hypertext link exists.

The Vendor cannot be held responsible for any problems or delays related to the functioning of payment systems.

The Vendor cannot guarantee the quality and continuity of the online sales service available on the Site.

8. Intellectual property

Each Product and all its components (text, images, logos, trademark), are protected by copyright. It is strictly forbidden to copy, reproduce, share or make available on any network whatsoever, including Internet, modify or misrepresent Products or its components without the express prior written consent of the Vendor.

As a result, the Vendor reserves the right to investigate and prosecute violations of any of these General Conditions of Sale to the fullest extent of the law, against all those who have, directly or indirectly, violated his rights.

9. Archiving, proof

The information of transaction (payment at the time the order is placed via PayPal using a credit card or a PayPal account) occurring after the purchase of one or more Products are stored in PayPal computer systems on a reliable and durable medium, and will be considered as evidence of orders placed and payments made by the Buyer.

10. Modification of the general conditions of sale

The Vendor reserves the right to modify the said General Conditions of Sale at any time, without notice or justification. In this case, the General Conditions of Sale shall be those in effect at the date the Buyer makes his purchase.

11. Awarding legal

The present General Conditions of Sale written above are governed by the French rights and to the exclusion of any other legislation.
